Bill Clinton Judge Strikes Down Trump Asylum Ban

While recently winning a decision against Democrats regarding his tax returns, President Trump continues being frustrated on the immigration front.

Yet again, he loses another immigration policy to the ruling of a biased judge as the administration will not be able to enforce asylum claims at the border.

Clinton Judge Ruling

Judge Randolph Moss, who was appointed to the bench by Bill Clinton, ruled against the administration’s assessment the mass increase in asylum claims is a “particular problem for the national interest.”

Judge Moss stated the claim “is neither sufficient to override a statutory mandate permitting all aliens present in the United States to apply for asylum” regardless if they are using an official entry port or not.

His ruling was made citing the Immigration and Nationality Act (INA) of 1965, which states anyone physically present in the country can request asylum regardless of how they entered the country.

The Trump administration was not saying they could not apply for asylum, however.

Instead, it was making the argument that since proper protocols were not followed, they were “ineligible” for consideration.

Moss addressed this issue, stating, “As a matter of common usage, no one would draw a meaningful distinction, for example, between a rule providing that children may not apply for a driver’s license and one providing that children are not eligible to receive a driver’s license.

“Both locutions mean the same thing.”

“The Rule’s direction that ‘an alien shall be ineligible for asylum’ if the alien entered the United States outside a designated port of entry is not ‘compatible’ with the congressional mandate that all aliens present in the United States may ‘apply’ for asylum, regardless of whether they entered the United States at a designated port of entry.”

What the court is not taking into consideration, though, is the fact we are currently facing so many asylum claims and the fact most of them are bogus.

Living in a poor country is not a reason to request asylum.

Furthermore, the government is finding that many of the claims of being in danger of violence are falsified.

Immigrants know this to be one of the standards for asylum so regardless of their situation, this is what they are now claiming.

Not to beat a dead horse, but we cannot continue to allow thousands upon thousands of people to floor the border centers every day.

Nobody is saying immigrants cannot come into this country, they just need to follow the laws and do it legally.

President Trump has been working diligently with countries where most of these immigrants are coming from to put rules in place where these individuals are permitted to seek asylum in those countries and remain there while their claim is processed.

Both Mexico and Guatemala have been cooperative on this front, but even those deals are being challenged in the courts by liberal organizations and Democrats.
